Terms of Service

1. Acceptance

By creating an account or otherwise using the Service, you confirm that you have read and agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility & accounts

You must be at least the age of majority in your jurisdiction to use the Service. You are responsible for the accuracy of your account information, for keeping your credentials confidential, and for all activity under your account. Notify us promptly of any unauthorized use.

3. Access & roles

Access to the Service is granted on request and may be capped or limited. Accounts carry a role — viewer, editor, or admin — that determines available functionality. New accounts start as viewer; elevated roles are granted by an administrator. We may modify, suspend, or revoke access in accordance with these Terms.

4. Acceptable use

You agree not to:

• upload content you do not have the rights to, or that infringes the rights of others or violates any law;
• upload material that is unlawful, harmful, or that you are not authorized to collect or process (including imagery captured in violation of applicable aviation or privacy laws);
• attempt to gain unauthorized access to the Service, other accounts, or our systems, or probe, scan, or test security without authorization;
• interfere with or disrupt the Service, or circumvent rate limits, quotas, or access controls;
• reverse engineer, scrape, or use the Service to build a competing product, except as permitted by law;
• misrepresent detection results as authoritative determinations where independent verification is warranted.

5. Your content & license

You retain all ownership rights in the imagery and data you upload ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display Your Content as necessary to operate and provide the Service, and to use Your Content and associated validation labels to evaluate and improve our detection models as described in the Privacy Policy.

You represent and warrant that you have all rights necessary to upload Your Content and to grant this license, and that Your Content does not violate any law or third-party right.

6. Our intellectual property

The Service, including its software, models, designs, and content (other than Your Content), is owned by NatureNet or its licensors and is protected by intellectual-property laws. These Terms do not grant you any right in our trademarks, logos, or branding without our prior written permission.

7. Detection accuracy

NatureNet uses machine-learning models to detect potential invasive species from aerial imagery. Detections are probabilistic predictions, not guarantees. They may include false positives and false negatives and are intended to assist, not replace, professional judgment and field verification. You are solely responsible for any decisions or actions taken based on outputs of the Service.

8. Availability & changes

We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may add, change, suspend, or discontinue features at any time. We may also perform maintenance that temporarily limits access.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

10. Limitation of liability

To the fullest extent permitted by law, NatureNet and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim arising from these Terms or the Service will not exceed the greater of the amounts you paid us in the twelve months preceding the claim or USD $100.

11. Indemnification

You agree to indemnify and hold harmless NatureNet and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Provisions that by their nature should survive termination (such as content licenses for already-processed data, disclaimers, and limitations of liability) will survive.

13. Governing law

These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Idaho for any dispute not subject to other agreed dispute resolution.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
